Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Facebook Fan Page is a public profile named HVAC Pro Blog on the Facebook social network, accessible from facebook.com/HVACMorin

• Business, for CCPA purposes, refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of processing it, and that does business in the State of California.
• Consumer, for CCPA purposes, means a natural person who is a California resident as defined by law.
• Sale, for CCPA purposes, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a Consumer’s Personal information to another business or third party for monetary or other valuable consideration.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data — While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, including but not limited to: email address, first and last name, and Usage Data.

Usage Data is collected automatically when using the Service. It may include Your Device’s IP address, browser type and version, the pages of our Service that You visit, the time and date of Your visit, time spent on those pages, unique device identifiers, and other diagnostic data. We may use Google Analytics to monitor and analyze use of our Service. This data may be shared with other Google services and used to contextualize and personalize Google’s own advertising network. Legal Basis for Processing Personal Data

We may process Personal Data based on: Your consent for one or more specific purposes; performance of a contract with You; compliance with a legal obligation; protecting vital interests of You or another person; a task carried out in the public interest; or Our legitimate interests. The Company will gladly help clarify the specific legal basis that applies to any given processing.

Your Rights under the GDPR

Facebook Fan Page

The Company is the Data Controller of Your Personal Data collected while using the Service. As operator of the Facebook Fan Page, the Company and Facebook are Joint Controllers under an agreement based on the Facebook Terms of Service.

We use the Facebook Insights function to obtain anonymized statistical data about Our users. Facebook places a Cookie on the device of any user visiting Our Facebook Fan Page, containing a unique identifier active for up to two years. Your Rights under the CCPA

If You are a California resident, You have the right to: notice of which categories of Personal Data are collected and why; access information regarding disclosure of Your Personal Data to third parties for direct marketing in the past 12 months; ask the Company not to sell Your Personal Data; know the categories collected, sources, business purpose, third parties it’s shared with, and the specific pieces collected about You; delete Personal Data collected in the past 12 months; and not be discriminated against for exercising any of these rights (denial of goods/services, different pricing, or reduced quality of service).

Exercising Your CCPA Rights

Email or call Us, or use our “Do Not Sell My Personal Information” section below. The Company will disclose and deliver required information free of charge within 45 days of a verifiable request, extendable once by an additional 45 days with prior notice when reasonably necessary.

Do Not Sell My Personal Information

We do not sell personal information. However, Service Providers We partner with (for example, advertising partners) may use technology on the Service that “sells” personal information as defined by the CCPA. If You wish to opt out of interest-based advertising and these potential sales, You may do so via the instructions below. Note that any opt-out is specific to the browser You use — You may need to opt out on every browser You use, and if You delete Your cookies You will need to opt out again.

“Do Not Track” (CalOPPA)

Our Service does not respond to Do Not Track signals. Some third-party websites do keep track of Your browsing activities; You can set browser preferences to signal that You do not want to be tracked.

California’s Shine the Light Law

Under California Civil Code Section 1798, California residents with an established business relationship with Us can request information once a year about sharing their Personal Data with third parties for direct marketing purposes — contact Us to request this.

Minor Users (Cal. Bus. & Prof. Code § 22581)

California residents under 18 who are registered users of the Service may request removal of content or information they have publicly posted by contacting Us and including the email address associated with Your account. This does not guarantee complete removal in all circumstances.
